Welcome to Diver’s Wave. By accessing our website, booking a scuba diving activity, enrolling in a course, purchasing products or gift vouchers, or participating in any service provided by Diver’s Wave, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.

These Terms govern all diving activities, scuba courses, guided dives, retail purchases, gift vouchers, and services provided by Diver’s Wave throughout the United Arab Emirates.

About Diver’s Wave 

Diver’s Wave provides recreational scuba diving instruction, guided diving experiences, snorkeling activities, PADI certification courses, equipment rental, and related diving services within the United Arab Emirates.

All diving activities are conducted in accordance with applicable UAE laws, maritime regulations, and internationally recognised PADI standards.

Eligibility 

Participants must:

• Meet the minimum age requirements for their selected activity.
• Meet the medical requirements established by PADI and the Recreational Scuba Training Council (RSTC).
• Complete all required documentation before participation.
• Follow all instructions provided by Diver’s Wave instructors, divemasters and boat crew.

Failure to satisfy these requirements may result in refusal of service without entitlement to compensation where permitted by law.

Bookings  

A booking is confirmed only after:

• payment has been received,
• availability has been confirmed,
• any required documents have been submitted.

Diver’s Wave reserves the right to refuse or cancel bookings where necessary for safety, legal compliance or operational reasons.

Price & Payments  

All prices are quoted in UAE Dirhams (AED).

Where applicable:

• UAE VAT will be charged in accordance with Federal Tax Authority regulations.
• Online payment processing fees may apply.
• Remaining balances must be settled before participation.

PADI Digital Products

PADI eLearning materials, digital codes and electronic learning resources become non-refundable once assigned to a student’s PADI account.

Medical Fitness 

Participants must complete all required medical questionnaires before diving.

Where required under PADI & Maritime standards, medical clearance from a licensed physician must be obtained before participation.

Providing false or incomplete medical information may result in immediate cancellation without refund.

Certification Requirement

Certified divers are responsible for presenting valid certification credentials where required.

Diver’s Wave reserves the right to verify certification status and refuse participation where certification cannot be verified.

Safety

Participant safety is the highest priority.
All participants agree to:

• follow instructor briefings,
• comply with boat safety procedures,
• follow UAE maritime regulations,
• obey instructions issued by the Captain and dive professionals,
• respect buddy procedures.

Failure to comply may result in removal from activities without refund.

Environmental Responsibility

Participants agree to:

• respect marine life,
• avoid touching coral,
• avoid disturbing marine animals,
• comply with marine conservation practices,
• avoid damaging underwater habitats.

Diver’s Wave reserves the right to terminate participation where environmental misconduct occurs.

Equipment

Rental equipment remains the property of Diver’s Wave.

Participants are responsible for equipment issued to them throughout the rental period.

Loss or damage caused through negligence may result in repair or replacement charges.

Participants using personal equipment remain responsible for ensuring it is suitable and properly maintained.

Photography & Media

During activities, photographs and videos may be captured for promotional purposes. If you prefer not to appear in photographs or videos, please notify our team before the activity begins.

Intellectual Property Website Use

All website content, logos, photographs, graphics, videos, educational materials and branding remain the intellectual property of Diver’s Wave unless otherwise stated.

No material may be copied, reproduced or redistributed without written permission.

Third-Party Services

Users agree not to:

• misuse the website,
• interfere with website security,
• upload malicious software,
• infringe intellectual property,
• use website content without permission.

Limitation of Liability

To the fullest extent permitted by applicable law, Diver’s Wave shall not be liable for indirect, incidental, consequential or special damages arising from participation in its activities or use of its website.

Nothing in these Terms excludes liability that cannot legally be excluded under UAE law.

Force Majeure

Diver’s Wave shall not be responsible for delays, cancellations or failure to perform services resulting from circumstances beyond reasonable control, including but not limited to:

• severe weather,
• Coast Guard restrictions,
• government actions,
• natural disasters,
• vessel breakdowns,
• pandemics,
• emergencies,
• port closures.

Changes to These Terms

Diver’s Wave may update these Terms & Conditions from time to time.

Updated versions become effective upon publication on this website.

Continued use of our services constitutes acceptance of the revised Terms.
